Motor Vehicle Act News: Transport Commissioner himself will come and tell the High Court, why every bike driver is not wearing a helmet!



Motor Vehicle Act News: High Court Jabalpur directed the Transport Commissioner of Madhya Pradesh to come and explain why the general public is not able to follow the rules of Motor Vehicle Act (Motor Vehicle Act News).


In fact, during the hearing in July 2023, the state government had given an undertaking that as per the Motor Vehicle Act News, every vehicle in the state will be fitted with a high security registration plate within the next 6 months.


Similarly, according to the rules of the Act (Motor Vehicle Act News), every two-wheeler driver will wear a helmet and the car driver will wear a seat belt.


The government had given an undertaking that after January 15, 2024, if even a single driver violates the rules of the Motor Vehicle Act News, then the Transport Commissioner and Additional Inspector General of Police will be responsible for contempt action.

The matter was heard on Tuesday. A counter-protest was presented by the state government and additional time was sought for complete compliance, which was rejected by the court.


HC asked – will the commissioner come himself or issue a warrant?

A bench headed by Chief Justice Ravi Malimath asked the Additional Advocate General whether he would produce the Transport Commissioner himself or issue a warrant. On this, the Additional Advocate General has assured to present the Transport Commissioner tomorrow on Wednesday.


Law student had filed the petition in 2021


Gwalior law student Aishwarya Shandilya had filed a PIL in the Gwalior bench in the year 2021. Considering the seriousness and scope of the matter, the Chief Justice transferred this petition from Gwalior bench to the main bench in Jabalpur.

On behalf of the petitioner, Gwalior's advocate Awadhesh Singh Tomar said that under the Motor Vehicle Act (Motor Vehicle Act News), it is mandatory for two-wheeler drivers to wear helmets.


Awadhesh Singh Tomar said that the Transport Department had issued a circular saying that the helmet should also be sold to the buyer from the same agency from which the vehicle is purchased. It was told in the petition that action is being taken only on paper in the state, the rules are not being followed on the ground.
